The regulations were issued following a process of prior consultation with the country's seven indigenous organisations, which was supported by the EUROCLIMA+ programme.

Lima, January 07, 2020.- The Framework Law on Climate Change is the main instrument that Peru has adopted to undertake the transformations that the country requires in terms of mitigation and adaptation to Climate Change, as well as to meet the commitments under the framework of its adherence to the Paris Agreement. It was unanimously approved by the Peruvian Congress on April 17, 2018.

On Wednesday, January 1, 2020, the regulation that will enable its application and consolidation into concrete public policies was published to: “coordinate, articulate, design, execute, report, monitor, evaluate and disseminate public policies for the comprehensive, participatory and transparent management of climate change adaptation and mitigation measures”. The regulation was approved by Supreme Decree N° 013-2019-MINAM, and it consists of six titles, 72 articles and 20 final complementary provisions.

This approval follows a broad process of prior consultation with indigenous peoples, as provided for in the Act on the Right to Prior Consultation of Indigenous or Native Peoples, recognised in International Labour Organisation Convention No. 169 concerning Indigenous and Tribal Peoples in Independent Countries.

This process was supported by the European Union's EUROCLIMA+ programme, under its “Gender and Vulnerable Groups” line of action, through FIIAPP and GIZ as implementing agencies. The aim was to develop an intercultural dialogue between the State and indigenous or native peoples in order to reach an agreement on the administrative measures proposed in the Regulations of the Framework Law on Climate Change, thereby contributing to the participation of indigenous or native peoples in the design and implementation of mitigation and adaptation measures in the framework of the nationally determined contributions.

The regulations establish, inter alia, the obligation to ensure spaces for participation with non-State actors, with a special emphasis on indigenous women, in the processes of designing, formulating, implementing and monitoring policies, strategies, plans, programmes and projects that incorporate adaptation and mitigation measures.

In addition, the same regulations propose the creation of the Indigenous Peoples' Platform to Address Climate Change as a forum for the management, coordination, exchange, systematisation, dissemination and monitoring of proposals for adaptation and mitigation measures by indigenous or native peoples. This Platform will also serve to disseminate their traditional and ancestral knowledge, practices and know-how that contribute to the comprehensive management of climate change. In this regard, Jéssica Huertas, an expert on Vulnerable Populations and Gender at the General Directorate for Climate Change and Desertification in Peru’s Ministry of the Environment, pointed out in a recent interview with EUROCLIMA+, the relevance of this platform to facilitate a space in which all indigenous peoples can exchange knowledge and strengthen them in climate action based on their prior knowledge and ancestral wisdom.
